Terms of Use: SmartSite

These terms govern use of the SmartSite web app (https://smartsite.sgfinfra.com) and the SmartSite mobile app (together, "the app"). By signing in you accept these terms. If you do not accept them, do not use the app and tell your administrator.

1. Who is who, and who may use the app

  • The Operator (SGF Infra Private Limited, "we") hosts and runs the SmartSite platform and publishes the app and these terms.
  • The Company ("your Company") is the construction company that employs or engages you and holds a workspace on the platform. Your Company's administrators create your account, assign your role and decide how the app is used for the Company's work. Where a Company self-hosts SmartSite, the Operator and the Company are the same entity.
  • You are an employee, engaged contractor or other person your Company has authorised to use the app ("authorised user").

Your relationship with your Company (employment, engagement, discipline, pay) is governed by your contract with your Company, not by these terms. These terms govern how you may use the app. Where these terms say the Company "may" do something, that is a decision for your Company, not the Operator.

  • The app is a business tool for construction companies. Access is granted only to employees, engaged contractors and other persons a Company authorises.
  • Accounts are created, assigned a role, and deactivated by your Company's administrators. There is no self-registration and you may not create an account for anyone else unless your role permits it. A Company is onboarded on the platform by the Operator.
  • You must be at least 18 years old.
  • Your access ends automatically when your employment or engagement with your Company ends, when an administrator deactivates your account, or when your Company stops using the platform, whichever is earlier.
  • Each Company's workspace is isolated. You may only ever see and act on your own Company's data.

2. Your account and credentials

  • Your login identity is your mobile phone number. Keep your password confidential, do not share it, and change it if you suspect it is known to anyone else (Me > Password).
  • You are responsible for all actions performed under your account. Tell your administrator immediately if your phone is lost or your account is misused; an administrator can end all your sessions and remove registered devices.
  • Do not sign in on someone else's account or let someone else sign in on yours, including to punch attendance.

3. Attendance, photos and accuracy of records

  • Attendance punches, site photos, expense entries, material receipts, fuel entries, task progress and every other record you make in the app are your Company's records that may be relied on for payroll, billing, accounting and legal purposes. You must make them truthfully and at the time and place they represent.
  • Attendance verification. A punch is accepted only when your phone's GPS position is inside the project's attendance radius and the selfie matches your enrolled face photos. You consent to this verification as a condition of self-punch. If you do not wish to use face verification, ask your supervisor to mark your attendance manually.
  • Driver mode. If an administrator has put your account in driver mode, you mark attendance once a day with a selfie from wherever you are; no geofence is checked. The selfie must still be of you, taken live at the moment of the punch, and the punch must represent a day on which you actually worked.
  • Prohibited spoofing. You must not: fake, mock or spoof GPS location; present a photograph, screen, mask or another person to the camera; punch for another person or ask someone to punch for you; enrol another person's face on your account; use modified or rooted devices or tools to bypass the app's checks; alter photos before upload. Every attempt is logged (including rejected attempts) and such conduct is a disciplinary matter for your Company and may be a criminal offence.
  • Photos of invoices and receipts must be of genuine documents for expenses actually incurred for your Company's work.

4. Location tracking and Company vehicles

  • What it is. Your Company may switch on background location tracking ("Track location") for drivers of Company vehicles and for other members whose role requires it. When it is on, the SmartSite mobile app sends your phone's position, speed, heading, accuracy, battery level and mock-location flag to your Company's workspace on the platform about every 2 hours (your Company sets the interval; default 120 minutes), plus a fix when you open the app and when you mark attendance, in the foreground and in the background, as described in section 6.3 of the Privacy Policy. Your Company's administrators see your last reported position on a map and the day's points as a trail linked to the vehicle assigned to you. The Operator never switches tracking on and does not view it except to operate and support the platform.
  • Your Company's obligations. Before tracking is enabled for you your Company will (a) tell you in writing or in the app that tracking is being enabled on your account, why, who can see the data and for how long it is kept; (b) state its policy on tracking hours: whether tracking runs at all times while the app is installed, or only during working hours, and what it expects of you outside those hours; and (c) show you a notice in the app that you must accept before the app asks your phone for background location permission. Tracking is never hidden: a persistent notification (Android) or the system location indicator (iPhone) is visible whenever the app is reporting, and the app shows your tracking status under Me. The data is used only for the purposes in the Privacy Policy, is never sold or shared, is never visible to another Company, and points are deleted after 90 days.
  • Your obligations while on duty. When tracking has been enabled for you and you are on duty (driving or in charge of a Company vehicle, or otherwise within the hours your Company has notified to you), you must: keep the app installed and signed in on the phone you carry; keep background location permission ("Allow all the time" / "Always") and precise location granted; keep the phone switched on, charged and with you or in the vehicle; and not use battery, network or mock-location settings, GPS spoofing apps, rooted or modified devices, a second phone, force-stopping the app, airplane mode or any other means to stop, block, delay or falsify the location reported. Deliberately leaving the phone elsewhere so that it reports a false position is treated the same as spoofing. Every point carries the operating system's mock-location flag and gaps are visible to administrators; evasion or falsification is a disciplinary matter for your Company.
  • Outside duty hours. Unless your Company's notice says that tracking is limited to working hours, the app keeps reporting whenever it is installed and permitted. You may raise this with your administrator, who can switch tracking off for you or adjust your Company's policy. Withdrawing the permission or uninstalling the app outside duty hours is not a breach of these terms; doing so during duty hours is, unless you have been told otherwise.
  • Vehicles. An administrator records which Company vehicle or machine is assigned to you and from when. Your location trail is attached to that vehicle. Tell your administrator on the same day if you drive a different vehicle, hand your vehicle to someone else, or stop driving, so that the assignment and the trail are correct. You must not drive a Company vehicle without a current assignment where your Company requires one.
  • Asking to stop. You can ask your administrator at any time to switch tracking off for your account. Whether tracking is a condition of a driving role is decided by your Company under your employment or engagement contract, not by the app or the Operator.

5. Acceptable use

You must not:

  • use the app for any purpose other than your Company's work;
  • upload content that is unlawful, defamatory, obscene, or that infringes anyone's rights;
  • upload malware or attempt to probe, scan, overload or interfere with the app, its server or other users;
  • disable, block, spoof, delay or falsify location tracking while on duty, or tamper with the persistent tracking notification or the app's tracking status (section 4);
  • attempt to access data of another Company, another project or another user beyond what your role allows, or circumvent permission checks;
  • export, copy or share your Company's data (parties, prices, drawings, financials, photos of colleagues) outside your Company except as your role and instructions require;
  • record or photograph third parties on site in a way that breaches their privacy or site rules.

6. Data and ownership

  • All data in your Company's workspace (records, photos, drawings, reports, exports) belongs to your Company. You retain no rights in it after your access ends. The Operator holds it only as your Company's processor and claims no ownership of it.
  • Your personal data is processed as described in the Privacy Policy at /privacy, which forms part of these terms and defines the roles of your Company (data fiduciary) and the Operator (data processor).
  • You may request deletion of your personal data as described at /delete-account. Business records you created remain with your Company as explained there.
  • Your Company may monitor use of the app, review the audit log and access any record in its workspace for security, accuracy, compliance and business purposes. The Operator may access data only to operate, secure and support the platform.

7. Devices and permissions

  • The mobile app requires camera and location (while using the app) permissions to function for attendance and photos, and asks for notification permission for approvals and to-dos. If tracking is enabled for you it additionally asks, after showing you the notice in section 4, for background location permission ("Allow all the time" on Android, "Always" on iPhone) and runs a persistent notification while reporting. Permissions are used only as described in the Privacy Policy.
  • Keep your device's operating system updated. Neither your Company nor the Operator is responsible for data charges, device faults or loss of data stored only on your device.
  • If you use a personal device, the app stores only a session token, a small cache and, while tracking is on, a short queue of location points waiting to be sent. Uninstalling the app removes them. Signing out removes the device from your account and stops tracking from that device.

8. Availability and changes

  • The app is provided for your Company's operational use. It may be unavailable during maintenance, network outages or incidents. The Operator may change, suspend or discontinue features at any time; your Company may switch modules and settings on or off for its workspace.
  • Offline entries are queued on the device and sent when connectivity returns; an entry is a Company record only once the server has accepted it.

9. Termination

  • Your Company may suspend or terminate your access at any time, with or without notice, including for breach of these terms, security reasons, or the end of your engagement. The Operator may suspend access that threatens the security or integrity of the platform.
  • On termination your sessions and devices are removed. Your personal data is handled as set out in the Privacy Policy and at /delete-account.

10. Disclaimer and liability

  • The app is provided "as is" for business use. To the extent permitted by law neither the Operator nor your Company makes any warranty that it is error-free or uninterrupted, and neither is liable to you for indirect or consequential loss arising from use of, or inability to use, the app.
  • Nothing in these terms limits liability that cannot be limited under applicable law, or affects rights you have under your employment or engagement contract, or under the agreement between your Company and the Operator.

11. Intellectual property

The app, its design, code and content are owned by or licensed to the Operator. Your Company holds a licence to use the platform for its business, and you are granted a limited, revocable, non-transferable licence to use the app for your Company's work for the duration of your authorisation. You may not copy, reverse engineer, or create derivative works of the app. The SmartSite name and logo are used with the Operator's permission only.

12. Governing law and disputes

These terms are governed by the laws of India. Courts at <<FILL: city, e.g. Bengaluru, Karnataka>> have exclusive jurisdiction, subject to any dispute-resolution process in your employment or engagement contract.

13. Changes to these terms

The Operator may update these terms. The current version is always at /terms with its effective date. Continued use after a change means acceptance of the updated terms; material changes will be notified in the app and to your Company.
